I haven't found the answer to my questions, 1 does it have to be a newcomer and 2 can you pick someone someone already else picked?

As long as the character has been announced for Brawl, you can choose them. If two or more people choose the same person, they play a game to see who gets it.

it doesn't have to be a newcomer it just has to be a CONFIRMED character at smashbros.com. For example don't go picking Ice Climbers until/if they are confirmed.

and yeah you can, just at a specific date all the people who are picking the same character can have a risk match and the winner can use that character.
