Gay Marriage...With a Twist

I have two male friends (who are on CC :-$ ) and they are not gay. But, they've been roommates for a really long time. With gay marriage becoming legal, they will be common law married soon.

Thoughts?

Well you could look to Canada to get some idea of how it would work out. Common law is the jurisdiction of the provinces so it differs province to province.

In general though there is a basic requirement that the people be in a "marriage" like relationship for a certain period of time. Also common law doesn't share all the same benefits.

Practically though your buddies could probably apply for whatever benefits common law would afford they would just have to pretend to be in relationship. I doubt anyone would really look into it unless they were being audited or something.

As to the divorce thing. A common law marriage doesn't require any official action to end it.
