It seems that 2 things need to be cleared up from the original post.

1. Did the guy tell the woman before sex that he didn't want/couldn't support children?

2. Did they not use contraception, or did they use it but it failed?

I'm not necessarily saying that either of these would matter to my answer, but they definitely matter to many of the posts made so far.

Different scenario. Man pokes hole in condoms to get his girlfriend pregnant. She gets pregnant. Doesn't want it, so she aborts it. Man gets charged for aggravated assault.

Now if the woman had poked the holes and got pregnant, more than likely the man would still be legally responsible for the child. And I highly doubt she would be charged with aggravated assault.

We seem to be assuming that from the second I unleash my sperms there is no room for negotiation. I think that the morning after is a perfectly legitimate time to tell her you do not want a child. All she has to do is take a pill and problem solved. If she chooses not to take the pill, she chooses to have a child that she knows you don't want.

And anyway, like natty says, sex is primarily for pleasure and not for procreation.

In the future, when we'll be able to create babbies simply by taking a piece of dna from both parents and putting them in some sort of artificial womb to ferment for a while, we can just sterilize everyone right after birth and no one has to be pregnant ever again and sex can be used 100% for fun only.

TGD is a lawyer of some type if you're trying to get a referral. I don't know if he does child support cases but it's worth asking.

It depends on the jurisdiction, I think and whether this is a criminal or civil matter (or both). Sorry to punt, but, well, that's what lawyers do.
