Exclusive: Lawyer says Guantanamo abuse worse since Obama

LONDON (Reuters) - Abuse of prisoners at Guantanamo Bay has worsened sharply since President Barack Obama took office as prison guards "get their kicks in" before the camp is closed, according to a lawyer who represents detainees.

Abuses began to pick up in December after Obama was elected, human rights lawyer Ahmed Ghappour told Reuters. He cited beatings, the dislocation of limbs, spraying of pepper spray into closed cells, applying pepper spray to toilet paper and over-forcefeeding detainees who are on hunger strike.

The Pentagon said on Monday that it had received renewed reports of prisoner abuse during a recent review of conditions at Guantanamo, but had concluded that all prisoners were being kept in accordance with the Geneva Conventions.

"According to my clients, there has been a ramping up in abuse since President Obama was inaugurated," said Ghappour, a British-American lawyer with Reprieve, a legal charity that represents 31 detainees at Guantanamo.

"If one was to use one's imagination, (one) could say that these traumatized, and for lack of a better word barbaric, guards were just basically trying to get their kicks in right now for fear that they won't be able to later," he said.

"Certainly in my experience there have been many, many more reported incidents of abuse since the inauguration," added Ghappour, who has visited Guantanamo six times since late September and based his comments on his own observations and conversations with both prisoners and guards.

He stressed the mistreatment did not appear to be directed from above, but was an initiative undertaken by frustrated U.S. army and navy jailers on the ground. It did not seem to be a reaction against the election of Obama, a Democrat who has pledged to close the prison camp within a year, but rather a realization that there was little time remaining before the last 241 detainees, all Muslim, are released.

"It's 'hey, let's have our fun while we can,'" said Ghappour, who helped secure the release this week of Binyam Mohamed, a British resident freed from Guantanamo Bay after more than four years in detention without trial or charge.

"I can't really imagine why you would get your kicks from abusing prisoners, but certainly, having spoken to certain guards who have been injured in Iraq, who indirectly or directly blame my clients for their injuries and the trauma they have suffered, it's not too difficult to put two and two together."

FORCE-FEEDING

Following a January 22 order from Obama, the U.S. Defense Department conducted a two-week review of conditions at Guantanamo ahead of the planned closure of the prison on Cuba.

Admiral Patrick Walsh, the review's author, acknowledged on Monday that reports of abuse had emerged but concluded all inmates were being treated in line with the Geneva Conventions.

"We heard allegations of abuse," he said, asked if detainees had reported torture. "And what we did at that point was to go back and investigate the allegation... What we found is that there were in some cases substantiated evidence where guards had misconduct, I think that would be the best way to put it."

Walsh said his review looked at 20 allegations of abuse, 14 of which were substantiated, but he did not go into details. Generally he said the abuse ranged from "gestures, comments, disrespect" to "preemptive use of pepper spray."

Ghappour said he had spoken to army guards who, unsolicited, had described the pleasure they took in abusing prisoners, whether interrupting prayer or physical mistreatment. He said they appeared unconcerned about potential repercussions.

He also saw evidence of guards pulling identity numbers off their uniforms or switching them once they were on duty in order to make it more difficult for them to be identified.

Ghappour said he had filed two complaints of serious detainee abuse since December 22 but received no response from U.S. authorities. In one case his client had his knee, shoulder and thumb dislocated by a group of guards, Ghappour said.

In one of the six main camps at Guantanamo, the lawyer said all the detainees he knew were on hunger strike and subject to force-feeding, including with laxatives that induced chronic diarrhea while they were strapped in their feeding chairs.

"Several of my clients have had toilet paper pepper-sprayed while they have had hemorrhoids," Ghappour said.

Another area of concern was evidence that detainees were being abused on the way to meetings with their lawyers -- sometimes so badly that they no longer wanted to meet with counsel for fear of the beatings they would receive, he said.

"Some detainees are convinced they are going to be locked up there forever, despite the promises to close the camp," he said.

Longest Serving Democratic Senator Slams Obama on Power Grab

Sen. Robert Byrd (D-W.Va.), the longest serving Democratic senator, is criticizing President Obama’s appointment of White House ā€œczarsā€ to oversee federal policy, saying these executive positions amount to a power grab by the executive branch.

In a letter to Obama on Wednesday, Byrd complained about Obama’s decision to create White House offices on health reform, urban affairs policy, and energy and climate change. Byrd said such positions ā€œcan threaten the Constitutional system of checks and balances. At the worst, White House staff have taken direction and control of programmatic areas that are the statutory responsibility of Senate-confirmed officials.ā€

While it's rare for Byrd to criticize a president in his own party, Byrd is a stern constitutional scholar who has always stood up for the legislative branch in its role in checking the power of the White House. Byrd no longer holds the powerful Appropriations chairmanship, so his criticism does not carry as much weight these days. Byrd repeatedly clashed with the Bush administration over executive power, and it appears that he's not limiting his criticism to Republican administrations/.

Byrd also wants Obama to limit claims of executive privilege while also ensuring that thes White House czars don’t have authority over Cabinet officers confirmed by the Senate.

ā€œAs presidential assistants and advisers, these White House staffers are not accountable for their actions to the Congress, to cabinet officials, and to virtually anyone but the president,ā€ Byrd wrote. ā€œThey rarely testify before congressional committees, and often shield the information and decision-making process behind the assertion of executive privilege. In too many instances, White House staff have been allowed to inhibit openness and transparency, and reduce accountability.ā€

The West Virginia Democrat on Wednesday asked Obama to ā€œconsider the following: that assertions of executive privilege will be made only by the president, or with the president’s specific approval; that senior White House personnel will be limited from exercising authority over any person, any program, and any funding within the statutory responsibility of a Senate-confirmed department or agency head; that the President will be responsible for resolving any disagreement between a Senate-confirmed agency or department head and White House staff; and that the lines of authority and responsibility in the Administration will be transparent and open to the American public.ā€

Obama faces a decision as early as next week on whether to support a claim of executive privilege made by former President Bush in refusing to allow Karl Rove, the former deputy White House chief of staff, to be deposed by the House Judiciary Committee on the White House’s role in the 2006 firing of nine U.S. attorneys.

Bush claimed ā€œabsolute immunityā€ for top advisors in resisting such subpoenas, by Rep. John Conyers (D-Mich.), chairman of the Judiciary Committee, filed a lawsuit over the issue. The case is on appeal, and the Obama administration is scheduled to file a motion next week laying out its stance on the issue.

A U.S. soldier on active duty in Iraq has called President Obama an "impostor" in a statement in which he affirmed plans to join as plaintiff in a challenge to Obama's eligibility to be commander in chief.

The statement was publicized by California attorney Orly Taitz who, along with her DefendOurFreedom.us Foundation, is working on a series of legal cases seeking to uncover Obama's birth records and other documents that would reveal whether he meets the requirements of the U.S. Constitution.

"As an active-duty officer in the United States Army, I have grave concerns about the constitutional eligibility of Barack Hussein Obama to hold the office of president of the United States," wrote Scott Easterling in a "to-whom-it-may-concern" letter.

Obama "has absolutely refused to provide to the American public his original birth certificate, as well as other documents which may prove or disprove his eligibility," Easterling wrote. "In fact, he has fought every attempt made by concerned citizens in their effort to force him to do so."

Taitz told WND she had advised Easterling to obtain legal counsel before making any statements regarding the commander-in-chief, but he insisted on moving forward. His contention is that as an active member of the U.S. military, he is required to follow orders from a sitting president, and he needs – on pain of court-martial – to know that Obama is eligible.

Taitz said other legal cases questioning Obama's eligibility filed by members of the military mostly have included retired officers, and courts several times have ruled they don't have standing to issue their challenge.

Easterling, however, is subject to enemy fire and certainly would have a reason to need to know the legitimacy of his orders, she argued.

"Until Mr. Obama releases a 'vault copy' of his original birth certificate for public review, I will consider him neither my Commander in Chief nor my President, but rather, a usurper to the Office – an impostor," his statement said.

Easterling said he joined the Army at age 40 after working in Iraq as a contractor.

"I chose to work … to support my troops and then left that lucrative position when the Army raised its maximum enlistment age to 40. Upon completion of basic training, I entered Officer Candidate School and commissioned as a 2LT in August 2007. After completing the subsequent basic officer leadership courses, I was assigned to Ft. Knox and shortly thereafter deployed to Balad, Iraq," he wrote.

"I implore all service-members and citizens to contact their senators and representatives and demand that they require Mr. Obama prove his eligibility. Our Constitution and our great nation must not be allowed to be disgraced," he wrote.

Taitz said Easterling is among the plaintiffs she is assembling for a new legal action over Obama's eligibility. Others include a list of state lawmakers who also would be required in their official position to follow orders of the president.

"My conviction is such that I am compelled to join Dr. Orly Taitz's lawsuit, as a plaintiff, against Mr. Obama. As a citizen, it pains me to do this, but as an officer, my sworn oath to support and defend our Constitution requires this action," he said.

Easterling was "saluted" in a forum on Taitz' website.

"Lt. Easterling, As a retired US Army SFC, I salute you sir as a true American patriot and hero! Thank you for your unselfish service to our country. It is rare to find someone today with such moral courage to do the right thing regardless of repercussions," said one contributor.

Said another, "For your voluntary service to our country, we owe you a debt we can never pay."

As WND reported yesterday, U.S. Sen. Richard Shelby, R-Ala., said during a meeting with constituents in Cullman County he has never seen proof the new president was born in Hawaii.

"Well, his father was Kenyan and they said he was born in Hawaii, but I haven't seen any birth certificate," Shelby said. "You have to be born in America to be president."

Shelby's office later stated the senator is confident of Obama's vetting process, although it did not elaborate.

WND has reported on multiple legal challenges to Obama's status as a "natural born citizen." The Constitution, Article 2, Section 1, states, "No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President."

Some of the lawsuits question whether he was actually born in Hawaii, as he insists. If he was born out of the country, Obama's American mother, the suits contend, was too young at the time of his birth to confer American citizenship to her son under the law at the time.

Other challenges have focused on Obama's citizenship through his father, a Kenyan subject to the jurisdiction of the United Kingdom at the time of his birth, thus making him a dual citizen. The cases contend the framers of the Constitution excluded dual citizens from qualifying as natural born.

Here is a partial listing and status update for some of the cases over Obama's eligibility:

New Jersey attorney Mario Apuzzo has filed a case on behalf of Charles Kerchner and others alleging Congress didn't properly ascertain that Obama is qualified to hold the office of president.

Philip J. Berg, a Pennsylvania Democrat, demanded that the courts verify Obama's original birth certificate and other documents proving his American citizenship. Berg's latest appeal, requesting an injunction to stop the Electoral College from selecting the 44th president, was denied.


Leo Donofrio of New Jersey filed a lawsuit claiming Obama's dual citizenship disqualified him from serving as president. His case was considered in conference by the U.S. Supreme Court but denied a full hearing.

Cort Wrotnowski filed suit against Connecticut's secretary of state, making a similar argument to Donofrio. His case was considered in conference by the U.S. Supreme Court, but was denied a full hearing.

Former presidential candidate Alan Keyes headlines a list of people filing a suit in California, in a case handled by the United States Justice Foundation, that asks the secretary of state to refuse to allow the state's 55 Electoral College votes to be cast in the 2008 presidential election until Obama verifies his eligibility to hold the office. The case is pending, and lawyers are seeking the public's support.

Chicago attorney Andy Martin sought legal action requiring Hawaii Gov. Linda Lingle to release Obama's vital statistics record. The case was dismissed by Hawaii Circuit Court Judge Bert Ayabe.


Lt. Col. Donald Sullivan sought a temporary restraining order to stop the Electoral College vote in North Carolina until Barack Obama's eligibility could be confirmed, alleging doubt about Obama's citizenship. His case was denied.


In Ohio, David M. Neal sued to force the secretary of state to request documents from the Federal Elections Commission, the Democratic National Committee, the Ohio Democratic Party and Obama to show the presidential candidate was born in Hawaii. The case was denied.


In Washington state, Steven Marquis sued the secretary of state seeking a determination on Obama's citizenship. The case was denied.


In Georgia, Rev. Tom Terry asked the state Supreme Court to authenticate Obama's birth certificate. His request for an injunction against Georgia's secretary of state was denied by Georgia Superior Court Judge Jerry W. Baxter.

California attorney Orly Taitz has brought a case, Lightfoot vs. Bowen, on behalf of Gail Lightfoot, the vice presidential candidate on the ballot with Ron Paul, four electors and two registered voters.

It's not his fault, but I suspect that there are going to be many more problems which arrise which aren't his fault but that he is powerless to fault. Think Bush with the recent economic collapse and 9/11, not his fault but a better man could have averted these things.

I'm not convinced that Obama is prepared for the kind of problems that are going to arrise durring his term. The man is completely out of his league.

Oh Player, while I appreciate your wise and considered posts, I'm afraid that's not how this game works. See, in the last administration, there were so many problems and genuinely awful things done, and so many of them led directly back to the executive office, that now that the opposing party is in power, the crybabies, I mean, party that lost, has to try and pin everything they possibly can on Obama.

This makes them look hilariously inept, petty, and yes, I'll say it, not too smart.

The guards are obviously in need of some serious discipline getting put into place, and need to knock off their little abuses of power.

See, in the last administration, there were so many problems and genuinely awful things done, and so many of them led directly back to the executive office, that now that the opposing party is in power, the crybabies, I mean, party that lost, has to try and pin everything they possibly can on Obama.

If by so many things led directly back to the executive office you mean three incidents of water boarding used on unquestioned terrorists than you're correct but that's very misleading phrasing. One would think you are either unfamiliar with what actually happened or that you are a liar.

The issue remains unresolved. His grandmother said she was there while he was being born in Kenya and he has yet to provide anything but a photo copy of a certificate of live birth to a website that he used to be on the board of.

... I have to take issue with this guy.

... When you are in the military, you're only job is to follow lawful orders. It matters naught who happens to be commander in chief.

... Now I said, "Lawful Orders" there, and any orders passed down from President Obama to Admirals and Generals may, technically, be constitutionally unlawful (IF he was Kenyan born). However orders given then by these Admirals and Generals to the lower ranks are indeed quite lawful in 99.9% of cases.

... This guy was a contractor in Iraq and just joined the Army at age 40 (the Army recently raised the max enlistment age). In my humble opinion, this is just some jerk with a political axe to grind, completely lacking in military bearing.

In all likeliness he's going to be court martialed for this but it does reveal an interesting undercurrent which exists. I don't know where Obama was born and I'm amazed that there is not a system which checks the qualifications of the President and that so few people seem to care that one does not exist. The bureaucracy is trying to block varrification every step of the way and there's something very wrong about that, especially when it should be such a simple document for Obama to produce.

I have mixed opinions as to what should happen to these guys. On one hand they are supposed to take orders like you said but on the other they take an oath to protect the Constitution from all enemies both foriegn and domestic. I'm not sure that I think that oath should only be practiced as a lip service.

Maybe recruits should start getting an education before they enlist in the military,
instead of waiting until after they've completed their service.

The presidential citizenship issue was resolved long ago...

I agree to be a plaintiff in the legal action to be filed by Orly Taitz, Esq. in a PETITION FOR A DECLARATORY JUDGEMENT THAT BARACK HUSSEIN OBAMA IS NOT QUALIFIED TO BE PRESIDENT of the U.S., nor TO BE COMMANDER IN CHIEF of the U.S. ARMED FORCES, in that I am or was a sworn member of the U.S. military (subject to recall), and therefore when serving as an active member of the military, I would be unable to follow any orders given by a Constitutionally unqualified Commander In Chief, since by doing so I would be subject to charges of aiding and abetting fraud and committing acts of treason.


I can present a long list of reasons, taken individually, which convinced me NOT to vote for Barack Hussein Obama; his crime associates in the USA, his lack of experience, the mystery of his citizenship, his promise to make coal power industry bankrupt through excessive regulations, his constant adjustment of position on issues, his tax plan, his spread the wealth admission, his obvious socialistic goals, his associations with foreign leaders unfriendly to the USA, the lies he tells about a range of subjects including perhaps who his biological father really is, his most recent revelation of having a "National Security Force" (whatever that is)...............all of these says he is a person of mystery, of no integrity, and in fact paints him with the same narcissist paint of Hitler, Stalin, Saddam, Mao, and Kim Jong Ill.

But then, there is a simple more direct, easier to understand reason that I did not vote for him and that is his lack of respect for the country that is giving him the opportunity to run for the highest office in the land........even though I personally think he is not constitutionally eligible.

But more than 50% of America voted for this charlatan and he now has the helm of the ship of state. Even so, he is not MY President. I will not refer to him as such. I will call him Resident Obama, and an illegal resident of the white house at that. I resent him for what he is not. He has not given proof that he is a natural born citizen of these United States. He has spent millions of dollars protecting the truth of his birth from public knowledge; therefore, it is obvious he has something to hide. He is an interloper, a usurper, a fake, a scam artist, a Chicago crook, a recipient of bribes and gratuitous income for which he paid no tax, a socialist (perhaps only a communist or Marxist), and a grave danger to the future of the America that I love and have protected since I was 17 years old.

I have told my two senators and my member of the House of Representatives. I have written 9 justices of the Supreme Court as well as President Bush before he left office. NONE have responded, therefore, they are all complicit and should all be severely punished for having failed in their sworn oath to protect and defend the constitution against all enemies, foreign and domestic. The instant Obamb was sworn in, he violated the oath he took because he took the office knowing he is ineligible and there stood Judge Roberts who should have immediately had Obama arrested and deported.

Other than this, my key short-term complaint is that he has not had a heart attack in office. But most important, what I really want is the truth; is Obama a natural born citizen of the United States. If not a natural born citizen, America has been defrauded and then we would be stuck with Joe Biden whose only redeeming attribute is that he is probably not a communist.

That's not what I'm saying. I wasn't even saying that I don't believe that he isn't American....
What I was trying to say is that there is a whole sub-culture of Americans who don't believe their tvs.
