JERUSALEM (AP) — Tens of thousands of Israelis poured into the streets of cities across the country on Sunday night in a spontaneous outburst of anger after Prime Minister Benjamin Netanyahu abruptly fired his defense minister for challenging the Israeli leader's judicial overhaul plan.

Protesters in Tel Aviv blocked a main highway and lit large bonfires, while police scuffled with protesters who gathered outside Netanyahu's private home in Jerusalem.

The unrest deepened a monthslong crisis over Netanyahu's plan to overhaul the judiciary, which has sparked mass protests, alarmed business leaders and former security chiefs and drawn concern from the United States and other close allies.

Netanyahu's dismissal of Defense Minister Yoav Gallant signaled that the prime minister and his allies will barrel ahead this week with the overhaul plan. Gallant had been the first senior member of the ruling Likud party to speak out against it, saying the deep divisions were threatening to weaken the military.

But as droves of protesters flooded the streets late into the night, Likud ministers began indicating willingness to hit the brakes. Culture Minister Micky Zohar, a Netanyahu confidant, said the party would support him if he decided to pause the judicial overhaul.

Israeli media said leaders in Netanyahu's coalition were to meet on Monday morning. Later in the day, the grassroots protest movement said it would hold another mass demonstration outside the Knesset, or parliament, in Jerusalem

Cracks are appearing in Nutty Yahoo's new coalition, and they will only widen as the days go on. Before long, he'll be out of office and waiting for the next indictment, just like a certain bum-buddy of his on this continent!

I think like the US it’s fair… the US is overly fair to criminals compared to victim IMHO.

The problem is not the criminal judicial system… but the over politicization of the judicial system.

It has been until now.

Nutty Yahoo is trying to take away judicial independence and make judges subject to the whim of the government.

YUP.

It all started because the so-called "State of Israel" "Supreme Court" kept blocking the Zionist plans to build more settlements in occupied Palestinian territory. So the militant Zionist extremists tried to enact new legislation that would give the so-called Knesset the ability to overrule the Supreme Court with a simple majority vote and continue their genocide without interruption.

They'll be stopped now but they'll keep trying. That's why From the River to the Sea, Palestine Must Be Free.

All of the aforementioned said, I do -- if I'm being objective -- commiserate a bit with Netanyahu's position.

Israel doesn't have a written constitution, instead it has the Basic Law. Right now the Supreme Court can invalidate amendments to the Basic Law if they'd violate the Basic Law. That would be like the U.S. Supreme Court ruling that parts of the constitution were unconstitutional. It's weird, circular reasoning.

The concept has served the Scandinavian nations well.

Adherence to the rule of law is an attitude, not a procedure. The minor details aren't important. What is important is that there is general agreement on the fact that the rule of law matters, and that the government is not above the law. Which, for the most part, is the prevailing attitude in Israel. The people can smell a rat when someone like Nutty tries to cheat.

The courts are also not above the law. The situation in Israel right now is that the Supreme Court can strike down laws, not because they objectively violate the constitution, but because they personally don't think they're reasonable.

Since the tenure of Aharon Barak as its chief justice, Israel’s highest court has arrogated to itself broad powers to overturn legislation and intervene in various aspects of public life, based only on its evaluation of the “reasonableness” of any particular measure. To David M. Weinberg, the concept of “reasonableness” has become an “authoritarian” tool that “allows high-court justices to apply elastically their own sensibilities; to re-engineer Israeli society—in their enlightened image, of course.”

    https://mosaicmagazine.com/picks/israel ... nableness/
If the U.S. Supreme Court invalidates a law it's because that law violates the U.S. constitution or a principle of English Common Law. If the Canadian Supreme Court invalidates a law it's because the law violates the Canadian constitution or a principle of English Common Law. In these cases the court must strike down laws it likes if they violate a legal principle, and uphold laws it hates if they don't.

If the Israeli Supreme Court invalidates a law it's because the court thinks the law is unreasonable based on its own emotions and worldview and no objective criteria. That's the opposite of rule of law. ROL requires neutral objectivity, not emotional subjectivity. "Reasonableness" is a political, not a judicial, question.

Again, though, I don't mind Netanyahu being neutered here since I'm 100% Anti-Netanyahu.

But just being completely objective, Netanyahu is in the right on one aspect of the judicial reforms, which is requiring the Supreme Court to objectively rule on the status of laws by reference to the Israeli constitution (Basic Law) rather than the judges' political preferences, and to limit its ability to find that the constitution itself is unconstitutional (which is completely bizarre).

That said, I'm glad clearer heads aren't prevailing and I'm happy Israel is tearing itself apart over this. Netanyahu has even said he's afraid of civil war --- how great would that be?! =D> =D> =D>
