Ghosts are changing the website?

Postby Songsting on Wed Oct 15, 2008 3:14 am

Things seem to be changing; "re-inforce" instead of "fortify", different style/colour of dice, classic map dissapeared etc etc. Yet no one seems to be talking about it on the forums. Am I the only one who didn't get a memo? Is the website under threat of closure form the makers of risk unless things seemed more 'original'?

Perhaps this thread may disappear soon too?

No offense taken, but I DID try to find the correct thread. One that is titled "Crazy Maps and Dice" and was started on the 15th July is not exactly one that appeared to me to be one that discusses changes from the last few days. However, I do thank you for directing me to the correct spot. Cheers!

I think the mods and people running CC are more focused on fixing the hole thing by hopefully
-creating a new classic map, thats similar to the old one.
-fixing clickable maps and bob
-then maybe let people know exactly why this has happend in detail.

But one things for sure, if they want people to stay on conquer club they better not leave it like this

Jebus... This is just horrible.

And totally unnecessary. A copyright covers a "work" and not "ideas". A board game conquiring the world using 6-numbered dices seems more to be an idea than a work. A toy company cannot possibly claim any sole right to this idea. What CC has done is merely developing this idea into something different. Up until now that is, this is just crap. I hate it.

tammsmu wrote:(4) and MOST IMPORTANT. They really don't have that good of a case. The copyright law protects expressions of ideas, not the ideas themselves. While the artwork from HASBRO's board game and the language in the rules might be copyrighted, the idea that a high number / dice beats a low number /dice when rolled randomly CANNOT be copyrighted. The idea that one accumulates bonuses that are drawn randomly CANNOT be copyrighted. Neither can most of the stuff on this site. The mechanics of CC are NOT THAT ORIGINAL. What can be copyrighted is all the different variations on the game created here. Each of these maps are the intellectual property of the creator or CC (depending on what you agreed to when you made them). HASBRO has no claim to any of this.

Oh. Just saw this. Good post. I agree with the above. Not possible.

The Middle Earth map is a different issue though. There you have an obvious use of a copyrighted work (i.e. the made-up original map). I think I even made a post re copyright issue in the map creation thread. Dunno what I said though.

tammsmu wrote:(5) Parody is also protected as fair use under the copyright act. Even if HASBRO made a case that somehow the individual mechanics of Risk were original, one is still allowed to parody a copyrighted work. There's a four part test for parody under the copyright act.

Nah. Don't think the fair use/aprody doctrine would be applicable in this case if I remember the case law correctly. But otherwise I agree with your post.

Online petition to save CC

Postby kletka on Wed Oct 15, 2008 4:07 am

We should launch an online petition on http://www.petitiononline.com. I would have done it already but it is worth consulting other members and waiting for an exact information from lack. So let us discuss exact text for now:

Title: Hands off conquerclub

Text:
To: Hasbro Games

Hands off conquerclub.com !!

Stop the makers of Risk, 'Hasbro' from ???whatever the ffff these morons are doing. It is a popular website, with over 20,000 users, many of whom are keen wargamers. It is revitalising the World's interest in Risk, and bringing you new customers ready to buy the board version. On the opposite your continuing meddling will result in boycott of your products. 1 of our users have already agreed to join boycott if the situation is not resolved.

Don't be fools Hasbro, do what you know is right!

Sincerely,

Well, as a member of conquer club, I think a LOT of people here are ignoring the facts of the situation.

I played the board game "Risk" with my friends on game nights and enjoyed it, and sought out a place where I could play online. I didn't go searching for "Feudal War, World V2.1" maps etc etc....

The classic map (old version) was identical to the board game risk except for the cards were colors instead of the board games soldier, cannon and cavalry.

If I honestly sit here and picture myself as a member of a jury being called in for a lawsuit having never really heard of www.conquerclub.com and not really caring about the board game risk because I maybe played it 1 time when I was a kid 20 years ago, what am I going to think when they present the facts.

Hasbro (whatever their name is) is going to present the case by showing their board game, then say "this website is making money off of our product by selling it online."

A jury isn't going to sit there and buy all the intellectual property bullshit, they are going to look at the facts and say "You copied it, your making money off their product" and there goes CC altogether. I'm quite sure that whoever runs CC does not have near the assets to go through a lawsuit like that and the end judgement (which is extremely likely) would probably take it down completely.

That means, we are just fucked.... well sort of at least.

Now what CC is telling me, is that I didn't join this website because I love the game Risk. I did pay money because I like the game Risk, that's the bottom line.

So, what do you do in situations like this? You pay them dividends/dues/fees/whatever.

To whoever runs CC, it's a great website and a lot of fun, but I do actually believe that you owe the owners of Risk for the rights to use their product.

For me, I can compare this to drinking beer. If I like to drink Corona beer, you can sit down and put a Budweiser in front of me all day long and tell me it's still a beer and I should just drink that. That does not believe I am going to start preferring Budweiser.

It's the same thing with the website. I like getting cards, rolling dice, taking territories and attacking other people. I don't want to get spoils and assaulting people. You may have changed something to the same thing, but I like it the other way.

You have just lost all the new people that come to this site looking to play "Online Risk" because it doesn't exist anymore.

It's time to negotiate with the Risk owners on how to keep their map on this site. You are abandoning your abilities to attract new members because they are going to skip past CC when they see you do NOT have online risk here.

Do what you need to do, change it back. Start paying dues to Hasbro, I'm sure you can still make money here. I'm willing to pay an extra $5-$10 a year to make up the difference (speaking only for myself though).

It is not the same, you have changed what I came here for. You lost my renewal unless it gets fixed. It's not a threat, I just am not going to pay money for something I don't like, and I don't like what this site turned into.

Postby isJESUSblack? on Wed Oct 15, 2008 4:44 am

I have joined the petition and will boycott as long as i have to untill this classic map is fixed. i have already decided to do a personal boycott and this only gives me a better reason to.

1st) The classic map doesn't even resemble the "risk" board. They have different territories(some the same),

2nd) what about the other sites? i just recently found a site that used the EXACT risk board and they had no affiliation with hasbro or risk. I did not join however because the site seemed like it was still a beta(I.E. laggy, bad text, ect.)

3rd) Why does Hasbro not just start their own risk site...im sure a plethra of people would join and be fullfilled.

4th) Why can't Hasbro just advertise here? It seems to me that would solve some problems.

5th) Why change the map to what it is now, it hurts my eyes. I have no idea what im attacking and constantly have to look at the board, it is a hasle and should be dealt with.

Thanks
