GOTCHA! Smugglers Nabbed at Border

Postby saxitoxin on Wed Jul 18, 2012 3:06 pm

Two gay men were detained at the U.S.-Canadian border for attempting to bring 6 Kinder Eggs into the U.S.

Possession of the Italian chocolate is banned in the U.S. and is subject to a $2,500 fine per egg. In hedonistic Canada, however, where anything goes, people sit around stuffing themselves with kinder eggs all day with not a care in the world. Disgusting.

Last year, U.S. Border Patrol seized more than 25,000 Kinder Eggs, highlighting the scope of the problem. It's unknown how many Kinder Eggs made it through the dragnet.

My wife and kids love Kinder Eggs. I think it's some of the worst chocolate I've ever tasted.

And I'm pretty sure Kinder Eggs are German, not Italian. Unless the company moved, I suppose.

As well, if I remember correctly, they are banned not because of the chocolate itself, but because of the very small toys inside.

You do understand that they're not illegal in Germany, right? We lived in Germany for six years.

When I win the lottery (that's right...I said WHEN!), I'm buying a castle in Germany!

That's actually pretty serious, except for the "when" part.

Incorrect. They're perfectly legal as long as you're not trying to sell them. The whole intact Kinder Eggs, on the other hand, cannot be brought in. Which makes no sense, since it's the toys that are the problem.

At one time, my wife owned every single toy they'd made to that point (I think it was around 2000). Some are worth some pretty decent money back in Germany.

I remember a time when kinder eggs were only sold in easter as a seasonal product. Now they're sold all year round. Guess that's why the youth of today is so fat, eh

According to the watchdogs at the CPSC, so much as bringing them into the fortified borders of the USA will earn you a $2500 fine per egg ... if you don't get shot trying to evade capture from the Kinder Egg Interdiction Teams of the Border Patrol. See:

CPSC wrote:Thank you for contacting the United States CPSC regarding Ferarro Kinder Surprise Eggs.

You asked us to clarify the ban on Ferraro Kinder Surprise Eggs in the United States.

The CPSC considers the toys marketed with Ferarro Kinder Surprise Eggs to be intended for children under three years of age. Therefore, they must comply with the small parts requirement under 16 C.F.R. Part 1501. When the toys within the plastic shells that are enclosed in the chocolate, contain small parts and are intended for children under age three years, they are considered banned in the U.S. and cannot be sold.

If the toys inside the plastic shell of the chocolate egg do not contain small parts, they are not banned in the United States.

In determining what toys and children’s articles are subject to the small parts requirement, CPSC considers the following factors under 16 C.F.R. § 1501.2(b): “[T]he manufacturer’s stated intent (such as on a label) if it is a reasonable one; the advertising, promotion, and marketing of the article; and whether the article is commonly recognized as being intended for children under 3.”

It is prohibited to sell, offer for sale, manufacture for sale, distribute in commerce or import in the United States any toy intended for children under three years of age that contains small parts.

http://freetheegg.wordpress.com/2011/04 ... -my-email/

However, if you were able to extract the toy from the egg first - since only the toy is banned, not the egg - then you could bring them in. But man doesn't have the science to do that yet.

Leave it to the Germans to invent a toy that will seek out and destroy the youth of America. Good thing the Iranians don't have such a weapon.

This this did is exactly confirm what I said above.
So...yeah. Six years is plenty of time to open them up and eat all the shitty-ass, plastique chocolate you want.

Wait, Kinder eggs are "intended for children under 3 years"? Since when?

At least around here, the wrappers explicitly warn AGAINST giving the eggs to children under the age of 3.

I think it's obvious what's going on here: the domestic chocolate egg producers of USA have lobbied for politics to ban kinder eggs because they wanted to get rid of the competition. Probably that weirdo chocolate factory guy with the midgets is behind all this.
